JUST SALAD GIFT CARD POLICY

The following gift card terms and conditions (the “Card Policy”) apply to the purchase, receipt and use of physical, e-gift cards, digital gift cards, and other gift cards or gift certificates that may be issued by JS Value, LLC ("JS") (all such cards collectively referred to herein as “Cards”). Your purchase, receipt and use of Cards constitutes your agreement to follow and be bound by this Gift Card Policy. JS reserves the right to change this Card Policy from time to time in its discretion, subject to compliance with all applicable laws. The most current version of this Card Policy will be available on this page and will supersede all previous versions of this Card Policy. Your continued use of a Card is your acceptance of all then-current terms and conditions. Void where prohibited, taxed or restricted by law. All federal, state and local laws and regulations apply.  Use of Cards are further governed by privacy terms and conditions available at https://justsalad.webgiftcardsales.com/privacy-policy/.

Cards have no expiration date, and you will not be subject to any dormancy fee, transaction fee, or other fees for use or non-use of this card. The Card is not a credit card and cannot be used as one. Cards are assigned a fixed monetary value. Use of the Card is limited to the amount of funds held on the Card and it is your responsibility to know the amount of available funds on your Card at all times. Cards may be redeemed in-store for purchases. Card balances may not be used to purchase other gift cards and cannot be reloaded, resold or transferred for value. For combinations with other offers, restrictions may apply.

Cards are not redeemable for cash, and Cards may not be returned for cash or other refunds, either prior to or subsequent to redemption, except to the extent required by applicable law. Except to the extent required by applicable law, any unused Card balance will otherwise remain in the recipient's Card account and such balances are not transferable. The full amount of each purchase, including taxes, will be deducted from the funds held on the Card, up to the total funds available on the Card. If a purchase made with a Card exceeds the amount of the Card, you must pay the balance as otherwise required by JS standard terms of sale and Terms and Conditions.

Cards and their use on the JS website are subject to the JS Privacy Policy, which is available at https://www.justsalad.com/privacy-policy. For any questions concerning your Card, please contact our Customer Service Help Center at https://www.justsalad.com/contact-us. Use of this Card for unauthorized advertising, marketing, sweepstakes or other promotional purposes is strictly prohibited.

Cards are subject to verification, and any Card that we believe in our sole discretion to have been purchased or obtained fraudulently or through illegal means will be subject to invalidation without refund. We are not responsible for hardware issues related to your device's access to the service so please check with the applicable device maker for compatibility. The use of Cards in any manner that states or implies that any person, website, business, product or service is endorsed or sponsored by, or otherwise affiliated with JS is prohibited without prior written approval.

THEFT, DIVERSION, REPRODUCTION, TRANSFER, SALE OR PURCHASE OF ANY GIFT CARD IS PROHIBITED. JS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO CARDS, INCLUDING WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.  IN THE EVENT A CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH CARD, TO THE EXTENT PERMITTED BY APPLICABLE LAW. THE RISK OF LOSS AND THE TITLE FOR CARDS PASS TO THE PURCHASER UPON OUR PHYSICAL OR ELECTRONIC TRANSMISSION TO THE RECIPIENT, WHICHEVER  IS APPLICABLE. ANY USE OF CARDS FOR UNAUTHORIZED PURPOSES IS STRICTLY PROHIBITED.  JS IS NOT RESPONSIBLE FOR ANY CARD THAT IS LOST, STOLEN, DESTROYED OR USED WITHOUT YOUR PERMISSION.  IN NO EVENT WILL JS BE LIABLE FOR ANY PUNITIVE, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES.

JUST SALAD TERMS OF USE

‍REFUND POLICY.
In-store: The decision regarding how to resolve any refund request is at the discretion of the manager of the store where the purchase was made (excluding delivery). A written copy of this policy is available upon request.
Digital Orders: Full refunds are only granted in unique instances whereby the guest experience has been altered significantly. Just Salad reserves the right to use discretion in issuing full refunds. Partial refunds are issued for missing items or ingredients. In circumstances where an order is incorrectly prepared, Just Salad will remake the item for no additional charge.

CANCELLATION POLICY. For orders placed on mobile or web, all users will receive a confirmation receipt sent to their email. If the order has already been prepared in-store, it is deemed non-cancellable and non-refundable. Guests are responsible for orders placed to an incorrect location, and additional charges may apply to transfer orders to the desired store.

‍STORE CREDIT. Store credit is issued in the form of a single-use promo code, valid only for digital orders. Promo codes are issued on a case-by-case basis and Just Salad reserves the right to cancel or revoke store credit at any time and for any reason.

6. Intellectual Property Rights

The Services and their contents, including all text, images, videos, and software, are owned by Just Salad or its licensors. Use of these materials is restricted to personal, non-commercial purposes as outlined below:

• Printing or downloading for personal use only, not for reproduction or redistribution.

Any other use requires express written consent from Just Salad.

7. E-Commerce and Loyalty Program Terms

7.1 E-Commerce Policies

7.1.1 Pricing and Payment

• Accepted payment methods include credit/debit cards, digital wallets, and other options as specified at checkout.
• Prices, including taxes and fees, will be displayed before purchase. Just Salad is not responsible for pricing errors but reserves the right to cancel orders if errors occur.

7.1.2 Refunds and Returns

• Refunds are issued at Just Salad’s discretion and are generally not available for completed orders unless required by law.
• Contact our support team promptly to address issues with your order.

7.1.3 Promotional Discounts

• Promotions or discounts are valid only under their specified terms.
• Discounts cannot be applied retroactively, combined with other offers, or transferred to another user or account.

7.2 Just Salad Rewards Program

7.2.1 Overview

The Just Salad Rewards Program (“Rewards Program”) is a customer engagement program provided by Just Salad and supported by third-party service provider Estimated, Inc. d/b/a Hang (“Hang”). By participating in the Rewards Program and providing us with your information, you agree to these Terms, the additional program-specific terms described herein, and the terms provided by Hang, available at Hang Terms of Service available at https://www.hang.com/terms.  Membership is voluntary, free and is open to legal residents of the United States who are 18 years of age or older. No purchase is necessary to become a member. Just Salad reserves the right to refuse membership to any applicant and membership is revocable without cause.  These Terms supplement and are subject to the Just Salad Privacy Policy at https://www.justsalad.com/privacy-policy, and other Terms of Use at on this website which are incorporated herein and made a part hereof. Please read these Terms carefully. If you do not agree to these Terms, please do not participate in the Rewards Program.

7.2.2 Enrollment and Participation

Opt-In Enrollment: Users may opt into the Rewards Program when creating an account or through other designated methods.  Your use of the Just Salad Website or Just Salad App is subject to additional terms and conditions. The Rewards Program is open to legal residents of the United States who: (A) possess the legal authority to agree to these terms; (B) reside in a jurisdiction which legally permits participation in the Rewards Program; (C) provide valid and accurate personal information when enrolling the Rewards Program; (D) is not already a member of the Rewards Program; (E) have not been previously removed or terminated from the Reward Program; and (F) are at least 18 years of age at the time of registration. The Rewards Program is not targeted, nor is it intended to be used by anyone under the age of 18.
Automatic Enrollment (Planned): In the future, users registering at the Just Salad Website or Just Salad App may automatically be enrolled in the Rewards Program. Users will be notified if this occurs and will have the option to opt out.

‍By enrolling, you authorize Just Salad and Hang to manage and administer your participation in the Rewards Program.  Your Rewards account, username, password, and information are for your personal use only. You are responsible for maintaining the confidentiality of and are responsible for all activities that occur under your Rewards account, username, password, credit card, gift card, and any other information that may be used to access your account. If you believe your account has been compromised, please contact us and take immediate action to remove the credit card, gift card, or other payment information associated with your account. Neither Just Salad nor any of its suppliers, contractors, or service providers are responsible for undeliverable, lost, returned, or misdirected emails or other correspondence related to your Rewards account.  You can withdraw from the Rewards Program at any time by submitting a request to our support team at [email protected].

7.2.3 Rewards Structure

The Rewards Program enables users to earn, collect, and redeem rewards through various activities, including but not limited to:

• Completing challenges.
• Engaging in games or interactive experiences.
• Receiving “mystery boxes” that may contain specific rewards.

Rewards may include discounts, free menu items, or other benefits as determined by Just Salad. The specific rewards, their availability, and redemption processes are subject to change at any time.

7.2.4 Expiration and Limitations

Unless otherwise stated in a specific promotion, all rewards issued through the Rewards Program expire within one month of issuance.  Some rewards may have shorter or longer expiration periods, as stated in the associated reward details.  Just Salad reserves the right in our sole discretion to determine the order in which qualifying Rewards are applied to transactions and their priority to promotional codes, gift cards, or other payment credits that are associated with your Rewards account. We cannot guarantee that the Rewards with the earliest expiration dates will be given priority in all transactions, and you agree to monitor your account regularly to verify the status of your Rewards account.

‍Rewards are non-transferable, non-refundable, and have no cash value. Rewards believed to have been sold, exchanged, or issued fraudulently, or issued to someone other than the eligible account member, will be void. 

As a general matter, each Rewards Program account may be used by and associated with only one person. However, Just Salad will permit members of the same household to use the same account so long as the above requirements are met, but we cannot separate Reward Program benefits or offers earned or used by different members of the same household using the same account.
At this time, the Reward Program cannot be earned or redeemed on third party delivery services. Your ability to apply a purchase to your account may be limited to participating locations. We reserve the right to offer additional rewards or decline to offer rewards in our sole discretion and without notice to you.  Additionally, at Just Salad’s sole discretion, we may choose to substitute a similar program for the Rewards Program at any time immediately upon notice to active account members. If the Rewards Program is terminated, all Rewards will be forfeited without any obligation or liability, and no award or reward claims will be honored after the conclusion of the relevant notice period.

7.2.5 Modifications and Termination

Just Salad reserves the right to modify or terminate the Rewards Program at any time.  Any modifications will be effective immediately upon posting the revision and, by accepting these Terms, you waive any right to receive special notice of such change. By continuing to use the Rewards Program, you agree to any revised Terms or policies posted by us. It is your responsibility to review the Terms periodically to be aware of any such changes.  Upon termination of the Rewards Program, any unused rewards will be forfeited.

7.2.6 Third-Party Involvement

Hang is the service provider facilitating the Rewards Program. By participating, you agree to Hang’s Terms of Service and Privacy Policy, which govern data handling and program administration.  Just Salad is not responsible for errors, outages, or other issues caused by Hang.

7.2.7 Dispute Resolution

Disputes related to the Rewards Program are subject to the arbitration and dispute resolution provisions in Section 10 of these Terms.  THE REWARDS PROGRAM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JUST SALAD MAKES NO REPRESENTATIONS OR WARRANTIES AND DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, WITH RESPECT TO THE REWARDS PROGRAM (INCLUDING THOSE RELATED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, THOSE ARISING OUT OF ANY COURSE OF DEALING, USAGE, OR TRADE, THAT THE REWARDS PROGRAM WILL BE ERROR FREE OR UNINTERRUPTED OR ALWAYS ACCESSIBLE, THAT ANY INFORMATION YOU SUBMIT, INCLUDING PERSONAL INFORMATION AND PAYMENT CARD INFORMATION, WILL BE SECURE OR FREE FROM UNAUTHORIZED ACCESS OR ACQUISITION, THAT OUR SITES OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT OUR SITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH OUR SITES WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.). NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM JUST SALAD OR THROUGH THE SITES WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN. JUST SALAD SHALL NOT BE LIABLE FOR UNAUTHORIZED USE, ALTERATION, THEFT OR DESTRUCTION OF A REWARDS CREDIT DUE TO ACCIDENT, MISUSE OR FRAUDULENT MEANS BY YOU OR A THIRD PARTY OR AS A RESULT OF CIRCUMSTANCES BEYOND OUR CONTROL. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL JUST SALAD OR ITS LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, OUR SITES, ANY WEBSITES LINKED TO IT, ANY CONTENT ON OUR SITES OR SUCH OTHER WEBSITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH OUR SITES OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER BASED ON WARRANTY, TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR ANY OTHER LEGAL THEORY, EVEN IF FORESEEABLE. IN THE EVENT OF ANY PROBLEM WITH THE REWARDS PROGRAM, YOU AGREE THAT YOUR SOLE REMEDY IS TO CEASE USING THE REWARDS PROGRAM. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE), OR OTHERWISE EXCEED THE GREATER OF (A) FIVE DOLLARS (US $5.00) OR (B) THE LOWEST AMOUNT PERMITTED BY APPLICABLE LAW. 7.2.8 Notice of Financial Incentive

For any financial incentive we offer, we have made a good faith calculation that the value of the personal information you provide is reasonably equivalent to the expenses we incur to provide you with the financial incentive offered. Our expenses include the collection and safeguarding of personal information, administration of the financial incentive offered, marketing costs, technical services, fraud prevention, event coordination, and employee training.  To enroll in the Rewards Program, we may collect your name, email address, phone number, and birthday. You can associate other personal information with your Rewards Program account, such as your address, delivery instructions, and dietary preferences. Rewards Program members may also receive exclusive offers, discounts, invites to events, sneak peeks at new menu items, special birthday gifts, and other surprise rewards. When you participate in the Rewards Program, you allow Just Salad our service providers and vendors, and our business partners to send you marketing communications and permit us to collect and use information about your purchases at Just Salad. Rewards Program benefits may be considered “financial incentives” provided in exchange for your personal information under some laws, including the California Consumer Privacy Act (“CCPA”).  We may also offer our customers voluntary opportunities to participate in surveys, email opt-ins, or other opportunities through which we may collect personal information, such as your name, email address, preferences, and opinions. 8. Disclaimers and Limitations of Liability

The Services are provided "as is" and "as available" without warranties of any kind. Just Salad disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Just Salad shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.

9. Indemnification

You agree to indemnify and hold harmless Just Salad, its affiliates, and service providers from any claims, damages, or expenses (including attorneys’ fees) arising from your violation of these Terms.

10. Dispute Resolution

10.1 Mandatory Arbitration

All disputes related to these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA). Exceptions include actions for injunctive relief to protect intellectual property.

10.2 Class Action Waiver

All claims must be brought individually. You waive any right to participate in class or collective proceedings.

10.3 Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Delaware. Disputes not subject to arbitration shall be resolved exclusively in courts located in New York County, New York.

11. Mobile App Terms

Use of our mobile app is governed by these Terms and the applicable app store's terms of service (including, but not limited to, the Apple App Store Terms of Service and the Google Play Terms of Service). Updates to the app may be required for continued functionality. Just Salad is not responsible for compatibility issues with unsupported devices or operating systems.
